High Court on Recusal

The Mississippi Supreme Court has adopted a new rule dealing with requests that appellate judges disqualify themselves from hearing certain cases.

The new rule states, in part, that anyone can move for a recusal if it appears a judge or justice's impartiality might be questioned. The new rule said the motion to recuse “shall be decided in the first instance by the justice or judge who is the subject of the motion.”

The judge's decision can be reviewed by the full court and the Supreme Court.
