Two Lauderdale County circuit judges have recused themselves from hearing a civil case filed by a dozen members of the 186th Air Refueling Wing against Jody Bryant and David Bertholf.
The lawsuit alleges the pair slandered the plaintiffs in a radio interview in 2003.
At the request of Bryant's attorney, Judge Larry Roberts, to whom the case was assigned, recused himself Tuesday due to one of the plaintiffs, Greg Malta, being a practicing attorney in the 10th Circuit Court District. Judge Robert Bailey has also recused himself. Malta also represents clients in Bailey's courtroom.
The chief justice of the Mississippi Supreme Court will be asked to appoint another judge to preside over hearings and the trial.
