A Montgomery judge plans a hearing Wednesday on a lawsuit challenging Gov. Bob Riley's line-item veto power.
It's a legal battle that could decide how $180.5 million is distributed among state courts and agencies in the year starting Oct. 1.
Montgomery County Circuit Judge Truman Hobbs set a hearing on the lawsuit for Wednesday. Seeking a hearing delay, Riley says he would appeal immediately to the state Supreme Court if Hobbs rules against him.
Rep. John Knight, D-Montgomery, says he would favor appealing if his side loses. The Legislature's Joint Fiscal Committee and three lawmakers who serve on it, including Knight, sued July 21.
