Brandon Police Chief Ken McBroom said the 19-year-old driver killed in a collision with a police cruiser on Nov. 9 had been drinking and had marijuana in his system at the time of the wreck.

McBroom said Officer Chad Maclain, who was rushing to a burglary in progress, has been cleared of any wrongdoing.

McBroom said Maclain followed all aspects of the department's standard officer procedure manual.

East Central Community College student Bradley McElroy, Jr., of Noxapater was killed when his car hit the police cruiser.

McBroom said McElroy had a blood alcohol content of .073. Mississippi's legal BAC is .08, but McElroy was under the legal drinking age of 21 and is subject to the state's zero tolerance underage BAC of .02.
