A federal court has scheduled arguments for July 7 on a request from Steve Michael Fasono for DNA testing that he claims will show he didn't rob a Morton bank in 2002.
The 5th U.S. Circuit Court of Appeals will hear the case in New Orleans.
Fasono was charged with robbing the Citizens State Bank in Morton. He was convicted and was sentenced in 2004 to 46 months in prison.
Fasono contends in court documents that DNA testing would show it was not he but someone else who wore a hard hat, shirt and sunglasses during the holdup.
A federal judge in Mississippi dismissed those Fasono's claims in 2008.
