Independent congressional candidate Jim Giles earlier withdrew a motion to be included in the debate, after it became obvious U.S. District Judge Henry Wingate would rule against it.
Giles claimed theNeshoba County Fair received public monies and could not exclude third party candidates.
Wingate said Giles did not prove that to the court.
The fair's attorney, Don Kilgore, said the event receives no public funding.
