A federal appeals court says Montgomery Federal Judge Myron Thompson acted correctly in dismissing a lawsuit that sought to return ousted Chief Justice Roy Moore's Ten Commandments monument to the state judicial building rotunda.
The Atlanta based 11th Circuit Court of Appeals ruled Friday that removing the monument and Moore was not in violation of the First Amendment.
The court maintained the monument was an unconstitutional state establishment of religion.
