Neshoba County Chief Deputy Kenny Moore confirmed on Monday that James Burnside, 40, was shot Sunday night during a struggle with Deputy John Lilly.

Moore said Burnside fled a roadside checkpoint. Lilly pursued him for about five miles, till Burnside stopped and fled his vehicle.

Burnside was taken to University Medical Center where he was listed Monday as critical, but stable.

According to department policy, Lilly is on administrative leave with pay while the Mississippi Highway Patrol conducts an investigation.
