Sierra Club Claims Power Plant's Permission Illegal

Attorneys for Mississippi Power Co. and the Sierra Club spent nearly four hours in a Harrison County courtroom Friday arguing about whether the economics of the power company's Kemper County lignite plant make sense right now.

Mississippi Power argued before Chancellor Jim Persons that it has always had a certificate to move forward with its construction project. And by the time a decision is rendered in this case, construction of the lignite plant should be 70 percent complete, the company said.

The Sierra Club was in court appealing permits issued to Mississippi Power to continue with construction of the Kemper County plant.

Persons did not immediately rule.

The Sierra Club wants Persons to rule that the new permission granted by the Mississippi Public Service Commission in April was illegal.
