A jury was chosen Monday in the case of a repossession gone bad.
Kenneth Smith of Birmingham is charged in the 2008 shooting death of 67-year-old Jimmy Tanks of Choctaw County, Ala.
The shooting happened during the early morning hours at Tanks' house in the Halsell community.
Family members say Tanks heard something outside and fired a shot in the air. That's when they say Smith, who was attempting to repossess Tanks' car, shot at Tanks.
"The family, we just all want the right thing done. We're just looking for that. If we can get that I guess that we'll have our satisfaction," says Tanks' brother, Hollis Pritchett.
Kenneth Smith's previous trial in the case ended in a hung jury. His new murder trial will continue Tuesday in Choctaw County Circuit Court.
