Family members of a teen who was run over by a vehicle and killed in 2009 have filed a wrongful death civil suit against the Attala County Fire Department.
According to WDAM-TV, former state legislator Jamie Franks is representing Benjamin Russell's family.
Attorneys are currently in the discovery process, and they will take depositions from three firefighters and Fire Chief Roy Watkins later this month.
Russell was driving on Highway 14 in Attala County Apr. 13, 2009, and swerved to avoid a deer. He hit a tree, and two Attala County fire trucks responded.
Russell's family members say one fire truck hit and killed Russell, who was 18 at the time.
The death investigation went to the grand jury just a month ago, and no felony indictment was returned.
