Mississippi Murder Conviction Stands

The Mississippi Supreme Court declined Thursday to hear an appeal from a Rankin County man convicted in a 2007 slaying.

Daniel F. Barber, Jr., was convicted of murder in 2009 in Rankin County in the shooting death of Patrick Spears of Jackson.

Pearl police, responding to a report of a shooting Dec. 20, 2007, found Spears lying in the street. Spears died of gunshot wounds to the chest and face.

Prosecutors say Spears was driving his car when Barber, who was walking, gestured for him to stop. The two men then argued. Barber struck Spears through the open car window. According to court records, Spears got out of his car and Barber shot him.

The state Court of Appeals last year rejected Barber's argument that he acted in self-defense.
