Judge to Look Again at Releasing Coal Plant Records

A group seeking records about Mississippi Power Co.'s Kemper County power plant will get another chance to persuade a judge to release them.

The Mississippi Supreme Court ruled that a Hinds County chancery judge should look again at whether some records relating to the $5 billion complex should be released to the Bigger Pie Forum.

That group, which opposes Kemper, says the records could prove that Mississippi Power, a unit of the Atlanta-based Southern Co., used incorrect assumptions about future natural gas prices to persuade Mississippi regulators to approve the plant.

In 2012, Hinds County Chancery Judge Dewayne Thomas ruled Mississippi Power had to release the documents. The company appealed, and during the appeal, Bigger Pie discovered that the company had released some information to it and a newspaper.
