Rewriting of Alabama State Constitution Questioned

Montgomery, Ala. The Alabama Supreme Court is divided over whether the state Legislature is acting legally by rewriting the state Constitution a few portions at a time.

Chief Justice Roy Moore and Justice Tom Parker have issued advisory opinions saying the article-by-article approach is not allowed by the Constitution. Moore says the Legislature is having an in-house constitutional convention rather than a constitutional convention of Alabama citizens. The other seven justices declined to weigh in on the issue.

Senate President Pro Tem Del Marsh says the advisory opinions have thrown cold water on the process, but he's hopeful of moving ahead with the revision of some articles before the legislative session ends next month.
